Meaning of terms

The publisher of the website www. drinkovic.hr is Polyclinic Dr. Ivan Drinković, with its registered office in Zagreb, Šulekova 5, personal identification number (OIB): 64514247517 (hereinafter: the “Publisher”). www. drinkovic.hr is a website through which the Publisher provides information about the products and services offered by the Publisher. A user of the website www. drinkovic.hr is a legal or natural person who in any way, whether directly or indirectly, uses or has used, accesses or has accessed the website www. drinkovic.hr (hereinafter: the “User”). The website includes all websites and their parts located within the domain www. drinkovic.hr.

General

These general terms of use of the website www.drinkovic.hr (hereinafter: the “General Terms”) prescribe the terms and rules relating to the use of the website www.drinkovic.hr. By using these websites, Users express that they agree with the terms and rules set out herein and agree to use the website www.drinkovic.hr in accordance with them. The right to use these websites is the personal right of the User and may not in any way be transferred to other natural or legal persons. The User is personally responsible for protecting the confidentiality of passwords, where such exist. The User is aware of the fact that technical problems sometimes occur in the operation of the Internet network, which may result in service interruptions or other events beyond the Publisher’s control, for which reason the Publisher is not responsible for any loss of data that may occur during the transmission of information on the Internet or any other event that may occur during the provision of services by the Publisher.

Changes to the General Terms of Use

The Publisher reserves the right at any time to amend or discontinue any segment of its business, including, without limitation, the time of availability, content, as well as the equipment required for access to or use of the websites. Likewise, the Publisher may stop sending information or part of the information, may change or discontinue any method of data transmission, and may change data transmission speeds, as well as any of their other characteristics. The Publisher reserves the right at any time, and without prior notice, if it deems it necessary, to discontinue or amend any of the General Terms of Use stated herein and/or the Data Confidentiality Statement. Such amendments may, among other things, include the introduction of certain fees or charges. If the General Terms of Use are changed and the User continues to use the website www.drinkovic.hr, it shall be deemed that the User accepts the General Terms of Use in their amended form. Any amendment or deletion of the General Terms of Use shall be valid against third parties immediately upon publication on the website www.drinkovic.hr. Any use of the relevant websites by the User after such change, except for becoming acquainted with the amendments to the General Terms of Use, shall be considered acceptance of those changes.

User conduct

It is the obligation and duty of the User to use the website www.drinkovic.hr exclusively in accordance with the regulations of the Republic of Croatia, as well as with general moral and ethical principles. Users may not publish or transmit through these websites any materials that endanger or in any way violate the rights of others, any material that is by its nature unlawful, threatening, offensive, defamatory, that invades or endangers privacy, that is vulgar, obscene, or otherwise undesirable in measured communication, that encourages unlawful activities, or otherwise violates any regulation and that, without the express, prior, written approval of the Publisher, contains advertising or an offer of anyone’s products and services. Any conduct of the User which, in the Publisher’s discretionary assessment, restricts or prevents any other User from using or enjoying the website www.drinkovic.hr is strictly prohibited. The User may not use the website www.drinkovic.hr for advertising or conducting any commercial, religious, political, or non-commercial promotion, including inviting Users of the website www.drinkovic.hr to become members of another online or offline service that constitutes direct or indirect competition, or potential competition, to the Publisher.

Intellectual property

All materials located on the website www.drinkovic.hr are the property of the Publisher and are as such protected by law, or are used in accordance with the approval of the copyright holders and the holders of trademark and/or design rights, as well as in accordance with other necessary approvals. The Publisher is also the copyright holder of the entire conceptual content of the website www.drinkovic.hr necessary for the proper and uninterrupted functioning of the project. Computer equipment

The User is solely responsible for procuring and maintaining their computer equipment, including all hardware and software they own and use, as well as other equipment necessary for access to and use of the website www.drinkovic.hr, and shall also independently bear all related costs. The Publisher excludes all liability for any damage to the User’s equipment and other property that may possibly arise as a result of using the website www.drinkovic.hr.

Supervision

The Publisher may at any time carry out control of the content on the website www.drinkovic.hr, especially the interactive part, with the aim of ensuring compliance with both these Terms and the applicable regulations of the Republic of Croatia. In accordance with the above, the Publisher reserves the right to remove any material which, in its own discretionary assessment, it determines is not in accordance with the terms set out herein, as well as to terminate passwords or user accounts of Users.

Licensing

By publishing comments, messages, or other information on the website www.drinkovic.hr, it is considered that the User grants the Publisher the right to use such comments, messages, or information for the purpose of promotion, advertising, market research, or any other legally permitted purpose.

Protection of User privacy and use of cookies

A cookie (cookie – hereinafter: “cookie(s)”) is information stored on the User’s computer by the website the User visits. Answers to questions, conclusions, opinions, views, remarks and/or any other statements contained in the “Naručite se” section represent only informative, indicative, and general information and cannot be relied upon without a professional examination and careful analysis that may be carried out exclusively by the Publisher’s expert staff. Answers to questions shall not be considered binding in relation to the Publisher, the User, or any third party. Answers to questions are based on the facts, circumstances, assumptions, data and/or statements presented in the submitted inquiries. When submitting an inquiry, the User confirms that they have presented all facts and circumstances known to them or which should be known to them in the ordinary course of events. If any of the relevant facts, circumstances, assumptions, data and/or statements is incorrect, the User is obliged to inform the Publisher thereof in writing, since the inaccuracy or incompleteness of the data may cause a change in the answer given. Answers to questions are based on the practice, professional achievements, technology and/or experience available at the time the answer is given to the submitted inquiry. Since the relevant practice, professional achievements, technology and/or experience are subject to change, it is not possible to ensure the timeliness of the answers provided over a future period. The answers given will not be updated with regard to changes in practice, professional achievements, technology and/or experience without the submission of an explicit repeated inquiry.

Warranty disclaimer and limitation of liability

The User agrees to use the website www.drinkovic.hr exclusively at their own risk. Neither the Publisher nor any person associated with the Publisher guarantees in any way that the use of the website www.drinkovic.hr will not be interrupted or that it will take place without operational difficulties. Likewise, the Publisher is not responsible for the consequences that may arise from the use of the website www.drinkovic.hr, nor for the accuracy, reliability, or content of any information, service, or goods provided through the relevant websites. This disclaimer of liability applies to any damages or possible injuries caused by any error, deletion, interruption, computer virus, malfunction, delay in operation or transmission, interruption in the communication line, theft, termination of contract, destruction, or unauthorized access, changes or misuse of records, inappropriate behavior, negligence, or any other action. Compensation for damages

By using the website www.drinkovic.hr, the User expressly confirms that they will not hold the Publisher, its affiliates, responsible persons in the company, employees, and agents liable for compensation of any damage and costs, including legal representation costs, which might arise from the User’s use of the website www.drinkovic.hr.

Termination of business relationship

The Publisher may at any time terminate the business relationship with any of its Users and revoke their passwords or user accounts. In such a case, the terms relating to the liability and obligations of the User shall remain in force. In the event that any provision of these General Terms of Use is void, such invalidity shall not affect the validity of any other provision of these General Terms, and the remaining parts of these General Terms shall remain in force, while the void provision shall be replaced by a valid provision that most closely corresponds in meaning and true purpose to the provision that is void. If the Publisher does not exercise its rights under these General Terms, this shall not be considered a waiver or loss of those rights, nor of any other rights stated herein. Polyclinic Dr. Ivan Drinković complies with the directive that advertising shall not be carried out toward persons under 18 years of age. It will not intimidate potential Users or depict unrealistic industry cases. Polyclinic Dr. Ivan Drinković will advertise its marketing materials ethically, in accordance with the law and the rules of the profession. For all legal disputes that may arise in connection with the use of the website www.drinkovic.hr, the court with subject-matter jurisdiction seated in Zagreb shall have jurisdiction. By registering/opening a user account on the website www.drinkovic.hr, it is deemed that the User has fully read, correctly interpreted, and accepted these General Terms.
